An arbitrator, mutually agreed upon by the parties, will preside over the arbitration. The prevailing party in the arbitration shall be entitled to recover its reasonable attorneys’ fees and costs.
  • Exceptions: Notwithstanding the above, AC Cleaning Services LLC may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent or restrain any breach or threatened breach of, or otherwise to specifically enforce, any of these Terms and Conditions.

c. Waiver of Class Actions:

  • Individual Claims: You acknowledge and accept that claims brought against AC Cleaning Services LLC shall be only on an individual basis and not as a plaintiff or class member in any possible future class or representative action or similar proceeding. Unless both you and AC Cleaning Services LLC agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not preside over any form of a representative or class proceeding.
